Trump could use his authority to make a "recess" appointment. That is, he could tell the Congress to adjourn. During that "recess," Trump could then appoint RFK, Jr.

A couple of things: 1) RFK, Jr. would not earn a paycheck via this means of taking the position since the Senate has not confirmed him. 2) RFK, Jr. would only be able to serve until the end of the current Congressional session (2026). At that point, RFK, Jr. would need to be nominated again -- and then go through the formal Senate approval/confirmation process.
