They seem to forget that juries decide what happens to people in Britain not judges.

"They" seem to have forgotten so much -- here in the U.S. and in Britain.

So the "judge" is saying that if you happen to be near some type of "commotion" and stop to observe, you too can be arrested????

Yes, guilty until proven innocent. Clearly the "judge" should not be employed as a shoe-shine boy let alone as a judge.
