My feeling/guess--- and that's all it is, is a feeling/guess-- is that much of the enforcement of these insane ideas is sporadic at best and dependent on the politics of the state. In some states I suspect that attitude is: "yeah, we're not doing that here." Sort of the same outlook many law enforcement agencies have re: g*n confiscation. "Yeah, we're not doing that here."
Plus... how many people do they have on staff for enforcement? I know that there are very few FDA inspectors, and I can't imagine that the state agricultural departments have staff to visit every farm large and small to enforce compliance.
